Wrongful Death Attorney: Suspicious Sudden Acceleration Leaves Couple Dead in Everett

wrongful death lawyerThere was a story in the Everett Herald today that piqued our interest and made us long for details. It was about a couple that was killed in Everett this weekend after their car crashed into a rock wall near Everett Community College.

Apparently this accident happened while their car was stopped in the parking lot of the College Plaza shopping center on N Broadway. Officers said that the man, 78, and the woman, 80, both believed to be from Everett, were in the lot just before 6 pm when it appears that their car suddenly accelerated for several hundred feet and slammed into the wall.

When emergency crews arrived, the woman passenger was pronounced dead at the scene, Everett police Sgt. Robert Goetz said.

The man died en route to Harborview Medical Center in Seattle.

Police have yet to interview anyone who saw the crash, Goetz said Tuesday. “We don’t know why this collision happened.”

The cause of the crash remained under investigation Tuesday.

The reason why it caught our eye is because the article didn’t mention what kind of car it was. We called the Everett Police to speak to Mr. Goetz, he was not in and the Everett Herald was not able to provide an answer as to the make or model of the car.

The make and model are important because if the car was a Toyota, then this could be a clear case of the car being affected by the sudden acceleration defect that caused the company to recall millions of its vehicles merely 9 months ago. Toyotas have been reported as suddenly accelerating to over 100 mph without being able to brake or shift out of gear in order to stop the vehicle.

Hundreds of lawsuits have been filed regarding this serious design flaw. Toyota has blamed it on it customers saying that the hundreds of cases stem from their feet slipping from the brake to the accelerator. But in this instance, could that happen for several hundred feet?

National Highway Traffic Safety Administration investigators found that many of the accidents showed no attempt to brake before the accident giving the impression that perhaps the drivers were unable or had given up trying to brake before the fatal accident.
