Car Crash Fatality - Seattle Auto Accident AttorneysEven though it is 2014 already, the 2012 complete fatality report has been finally compiled and released. The Fatality Analysis Reporting System (FARS) and the National Highway Traffic Safety Administration have released the 2012 fatality report and the numbers are not good. In 2012, there were more than 33,561 deaths –a 1,082 increase from 2011. What is troublesome is that large truck, motorcycle, and pedestrian fatalities increased drastically, as did drunk driving fatalities. Here are some of the highlights from the 2012 Fatality Report:

  • There was a 6.4% increase in pedestrian fatalities in 2012, making it the third consecutive year pedestrian fatalities increased.
  • The majority of fatal pedestrian accidents occurred in urban areas, at non-intersections, and at night.
  • There was a 7.1% increase in motorcycle fatalities in 2012, making it the third straight year motorcycle fatalities increased.
  • 10x as many non-helmeted riders died in 2012.
  • There was a 8.9% increase in large truck occupant fatalities in 2012, making it the third straight year truck fatalities increased.
  • There was a 4.9% increase in drunk driving fatalities.
  • The majority of the drunk driving fatalities involved a driver with a BAC of 0.15 or higher (which is double the legal limit).
  • People are still not wearing their seatbelts. Nearly 2/3 of the nighttime fatalities involved drivers and passengers who were not wearing their seatbelts.
  • Males continue to comprise nearly 70% of all motor vehicle fatalities and have for decades.
  • In Washington, there were 444 total traffic fatalities in 2012.
  • Of those traffic fatalities, 33% involved drivers who were driving under the influence of alcohol.
  • The total number of fatalities in the State of Washington actually decreased by 2.2% in 2012.

Snow Driving - Seattle Auto Accident AttorneysDo you think you drive safely in snowy or icy weather? If you answered yes, then you are among the majority, according to a recent poll from PEMCO insurance. 4 out of 5 Northwest drivers believed that they were just as skilled or more skilled at driving safely in the snow than their fellow drivers. Even more shocking—only 37% of Washington drivers actually took basic safety precautions, such as carrying chains in their cars and over 53% didn’t even know how to install tire chains. This misguided self-confidence can be dangerous on the roads.

It seems that where a driver lives in Washington may have something to do with their confidence in the snow and ice. 64% of Eastern Washington drivers say that they are comfortable driving in winter weather. This is in comparison to the 53% of drivers in Western Washington who felt the same way.

According to the Washington State Department of Transportation, the majority of accidents in Washington occur in the fall and winter when weather conditions are not ideal. As such, safety experts urge drivers to stay indoors when weather is bad. Yet many drivers in Washington don’t heed these warnings.

While winter is already upon us, drivers in Seattle and throughout the State of Washington can learn from these polls. Always keep emergency kits in your vehicle and if you don’t have to venture out in bad weather—don’t. Stay indoors until the bad weather has passed and roads are cleared. This is the main way to prevent dangerous and deadly winter car accidents from occurring.

If you or someone you love is injured by a negligent driver this winter, it is important to speak to an auto accident attorney immediately. Your attorney will be able to review your case closely and help you obtain the compensation you need to recover from your injuries and put your life back together.

Motorcycle Accident - Washington StateMarijuana has been legal in the State of Washington for a year now—driving under the influence of marijuana, however, is not. A Bellevue man was recently charged with vehicular homicide after he collided with a motorcyclist on October 4th. Prosecutors allege that Caleb Floyd was driving high on marijuana when he collided with Bellevue motorcyclist Blake Gaston. Blood drawn from Floyd’s blood found levels of THC that were twice the legal limit.

The Bellevue motorcycle accident occurred when Gaston was crossing 102nd Avenue Northeast on Northeast 10th Street. Floyd was heading east when he suddenly cut left. Gaston was unable to stop and laid his KTM 450 motorcycle down and into the side of Floyd’s car. He suffered catastrophic injuries, including massive head trauma and was pronounced dead at Overlake Medical Center.

Now that marijuana is legal in Washington, law enforcement officials and state prosecutors now have to contend with drivers who are driving under the influence of pot. In the fist 6 months of 2013, 745 drivers tested positive for THC when pulled over by police officers. Over half of those were over the state’s new legal limit of 5 nanograms of THC per milliliter of blood. Whenever anyone operates a vehicle under the influence of drugs or alcohol, the results can be deadly.

Motorcyclists, in general, are at risk for sustaining fatal injuries, due to the limited protection a motorcycle offers. Even when they are hit at relatively low rates of speed, motorcyclists can suffer serious head injuries, spinal cord injuries, and life threatening complications. Sadly, the majority of motorcycle accidents occur because of inattentive motorists who simply fail to recognize the motorcyclist on the road.

According to statistics, motorcyclists are not likely to escape an accident unharmed. In fact, 98% of multiple motor vehicle accidents and 96% of single vehicle accidents result in motorcyclists being injured. Of those, 45% of motorcyclists escape with only a minor injury. This means that the majority of injured motorcyclists sustain a serious injury after a motorcycle accident.

Head-on Collision - Washington StateA multi-car accident occurred this month in Eatonville when a 48-year-old man crashed his pickup truck head-on into another truck on State Route 7. Glenn T. Fitting was on his way to the hospital complaining of chest pain and back pain. According to the Washington State Patrol, it appears that Fitting had a fatal heart attack that caused him to crash his truck head-on into a Chevy pickup carrying two adults and 4 children. The adults involved in the accident were listed in serious condition and one of the children was in critical condition at Seattle’s Harborview Medical Center following the accident.

In Washington State there were 457 traffic fatalities in 2011 alone. While head-on collisions are the least common of all accidents, they are the most deadly. For example, in 2005, head-on collisions in the United States accounted for only 2% of all crashes, yet 10% of all fatalities. The reason is because head-on collisions rarely give either driver a chance to slow down or even maneuver to avoid them. The result is an accident that occurs at high speed and with little warning.

According to FARS (Fatality Analysis Reporting System) 75% of all head on collisions occur on undivided, two lane rural highways. The majority of these accidents occur when drivers are distracted, impaired, or asleep behind the wheel of the vehicle.

Due to the high rates of speed associated with head-on collisions, the injuries that are sustained are usually severe and life threatening. Common head-on accident injuries include:

  • Traumatic brain injuries
  • Disfigurement
  • Spinal Cord injuries
  • Paralysis
  • Loss of limbs
  • Severe soft tissue injuries
  • Fractures
  • And more

Winter Driving - Seattle, Washington State

The winter season is officially underway and this year it has been particularly harsh for many in Washington and throughout the United States. Snow, sleet, freezing rain, and high winds often combine to create deadly car accidents throughout Seattle and the State of Washington. While most safety experts warn drivers to stay home during severe weather, if you are forced to drive on the roads, you want to keep a few safety tips in mind.

Prepare Your Car for Winter—the preparation starts early. Before winter actually arrives, it is best to check your tires and fluid levels carefully. Ensure that you have enough antifreeze in your car and that your car heater is working efficiently. Also be sure you have proper tread left on your tires and that your tires are properly inflated. Under-inflated tires cause more than 600 fatalities every year.

Prepare an Emergency Car Kit—before you head out, be sure you have an emergency car kit prepared. Your first aid kit should be fully supplied with bandages and any medications you might need. You should also have working road flares and a blanket in your car in case you are trapped in cold weather conditions. To be on the safe side, pack a small container of kitty litter in your vehicle to help you gain traction on snow or ice, in the event your tires get stuck. A small shovel, an extra pair of gloves, and a gallon of water are also necessary to have in your trunk. For more information check out: http://www.ready.gov/kit-storage-locations

Drive Slowly and Carefully—when driving in bad weather, it is important to keep your full attention on the road. Consider putting your cellphone in the glove box or turning it off altogether to save battery power and prevent distractions. Never drive above the posted speed limit sign, especially in snowy or icy weather and maintain an even longer distance behind other vehicles.

Texting While Driving - Washington State

In 2011, 1.3 million car accidents were caused by cellphone use. Texting while driving is growing, despite numerous safety ad campaigns and public awareness messages. In fact, 34% of all drivers have admitted to texting while driving and 52% have admitted to talking on the cellphone while driving. What’s even worse, is that a staggering 77% of young adults actually believe that they can safely text and drive.

Texting and driving is a lethal combination. In 2012, an estimated 421,000 people were injured in motor vehicle crashes that involved a distracted driver. This was a 9% increase from 2011. Yet even with these statistics, the majority of drivers still routinely use their cellphone while driving. In fact, at any given moment, an estimated 800,000 drivers are using a hand-held cell phone.

While texting and driving is illegal in Washington State, drivers still continue to engage in this risky behavior. When they do, the increase the likelihood of getting into car crashes by 23x. Why? The National Highway Traffic Safety Administration reported that a texting driver’s eyes are off the road for at least 5 seconds. That is enough time to travel the full length of a football field when traveling at 55mph.

If you want to prevent catastrophic and deadly car accidents, it is important to put down the cellphone and pay attention to the road ahead. Encourage friends and family members to avoid texting or calling you when they know you are in the car driving. If your cellphone is a distraction, consider placing it in the glove box while driving or turning it off completely.

They are more than just inconvenient or potentially expensive, tire blowouts are also one of the leading causes of car accidents, and they occur more frequently during the summer months.

In higher temperatures, tire treads wear down more quickly, which can significantly and rapidly reduce the amount of usable wear left on your tires, especially when covering long distances while on vacation.

According to the National Highway Traffic Safety Administration, every year, on average, 400 people die due to complications from an accident involving tire failure. Many factors can contribute to blowouts, including; overly worn or improperly inflated tires, deep punctures, potholes, and overloading a vehicle.

Another safety hazard can occur when large trucks experience a blowout and the treads are left on the highway indefinitely for thousands of other drivers to run over them or try to swerve around them.

Maintaining a safe distance between your vehicle and others while on the road is another smart safety measure. If you are following too closely when another vehicle experiences a blowout, particularly a tractor-trailer, you could be putting yourself in harm’s way.

Inspecting your own tires for proper inflation and wear before taking to the road is always a good idea. New tires typically have a tread depth of 10/32”. Your tires will need to be replaced soon after they wear to a depth of 1/8”. 1/16” is the minimum depth allowed on most states’ roads and is considered extremely hazardous.

The penny test is a simple way to check treads on your tires. Place a penny upside down into the tread of your tires. If you can see Lincoln’s head or space above it, you need to replace that tire immediately. If you cannot see any of Lincoln’s hair, your tires are in good shape.

Uneven wear on your tires could indicate that your car needs other maintenance, such as tire rotation or balance, suspension adjustment or front-end alignment. Consult your vehicle maintenance guide for proper inflation tips and invest in an inexpensive gauge to monitor tire pressure.

Despite preventative measures and advanced tire technology, blowouts still can occur. If your vehicle does have a blowout, try your best to do these three things:

  • Keep your rate of speed up so that following vehicles are less likely to rear-end you
  • Steer against the direction your vehicle is tugging after the blowout
  • As the car stabilizes, slow down and pull over as soon as possible

While the National Highway Traffic Safety Administration (NHTSA) has issued driver distraction guidelines to address visual and manual sources of distraction, there are currently no standards that apply exclusively to cognitive distraction. In June, research was published suggesting that the move to voice-based interactions in vehicles may have the unintended consequence of adversely affecting traffic safety.

The goal of the study, sponsored by the American Automobile Association (AAA), was to establish a standardized framework for measuring and understanding cognitive distraction in the vehicle. Thirty-two participants, ranging in age from 18-33 were involved in the study which consisted of three experiments.

The first experiment served as a control in which participants performed eight tasks without the concurrent operation of a motor vehicle. In the second experiment, participants performed the same eight tasks while operating a high-fidelity driving simulator. In the third experiment, participants performed the eight tasks while driving an instrumented vehicle in a residential area of a city.

In each experiment, the tasks involved;

  • A baseline single-task condition (i.e., no concurrent secondary task)
  • Concurrent listening to the radio
  • Concurrent listening to a book on tape
  • Concurrent conversation with a passenger seated next to the participant
  • Concurrent conversation on a hand-held cell phone
  • Concurrent conversation on a hands-free cell phone
  • Concurrent interaction with a speech-to-text interfaced e-mail system
  • Concurrent performance with an auditory version of the Operation Span (OSPAN) task

With the exception of the hand-held cell phone condition, each task allowed the driver to keep his or her eyes on the road and hands on the steering wheel, so any impairment to driving must be a result of cognitive sources associated with distraction from the task of operating the vehicle.

The data was then used to develop a rating system for cognitive distraction where non-distracted single-task driving represented the low end (Category 1), and the OSPAN task represented the high-end (Category 5) of the scale. In-vehicle activities such as listening to the radio (1.21) or an audio book (1.75) were associated with a small increase in cognitive distraction, the conversation activities of talking to a passenger in the vehicle (2.33) or chatting with a friend on a hand-held (2.45) or hands-free cell phone (2.27) were associated with a moderate increase in cognitive distraction, and the speech-to-text condition (3.06) had a large cognitive distraction rating. These findings can be used to help create scientifically-based policies on driver distractions, particularly as they relate to cognitive distraction resulting from the diversion of attention to other concurrent activities in the vehicle.

Increasingly, automobile manufacturers and third-party providers are offering consumers the ability to utilize voice commands for controlling everything from functions of the vehicle to making dinner reservations. The information gathered from this study show that such voice-based interaction, in some instances, caused driving impairments similar to those associated with drunk driving. The lesson to be learned is that hands-free does not necessarily equal risk-free.

The Dangers of Distracted Driving

Categories:

Sending or receiving a text takes a driver’s eyes from the road for an average of 4.6 seconds, the equivalent-at 55 mph-of driving the length of an entire football field, blind.

There are three types of distracted driving, manual, visual and cognitive. Texting while driving is the perfect example of utilizing all three types of distracted driving at once. When you look down at your phone, your eyes are off of the road for an average of 4.6 seconds (visual distraction), during that time your mind is focused on your text message (cognitive distraction), and one or more hands are involved in the actions of the texting motion (physical distraction). At 4.6 seconds of visual distraction at 55 mph, texting while driving is the equivalent of driving an entire length of a football field blind. This is a clear example of why texting while driving is not only dangerous, it kills.

Driving while using a mobile device reduces the amount of brain activity associated with driving by 37%.

When you text while driving you not only endanger yourself, but the people in your vehicle and those on the road around you. Texting while driving increases your risk of getting in an accident by an astonishing 23 percent. Teens under age 20 are most tempted to text while driving with a reported 40% of all American teens admitting to have been in a car when the driver used a cell phone in a way that put people in danger.

Texting While driving is Not the Only Activity under the Distracted Driving Category

According to a HealthDay poll from November 2011, most adults who drive admit to engaging in distracted driving behaviors. This poll included 2,800 American adults and results found that:

  • Approximately 86% of drivers have admitted to occasionally eating or drinking while driving
  • Approximately 37% of drivers have texted while driving at least once, while 18% of drivers have said they have formed the habit of doing it often
  • 41% of adult drivers have set or changed a GPS system while driving, and 21% do it “more frequently”
  • Approximately 36% of adult drivers have used a map as road guidance while driving
  • At least 1 out of every 5 drivers have admitted to combing or styling their hair while driving
  • Approximately 14% of drivers have applied makeup while driving
  • Approximately 13% of adult drivers have browsed the Internet while driving

What can you do to stop this behavior?

Distracted driving is currently the number one killer of American teens. If you are a parent, talk to your teen about the dangers of distracted driving and take a pledge together in an effort to end distracted driving. Safety starts with you. Have a serious conversation with your loved ones and explain what they mean to you and how you don’t want to lose them in an accident.

Broken bones are some of the most common personal injuries that medical professionals come across when treating accident victims either at the scene or when they enter the hospital. These injuries can be painful and take months to heal. Not only that, depending on the victim’s age, older people can find that the healing process can be extended by weeks, even months.

Bones healing is a process of time, circulation, and health. It takes 3 to 4 months to recreate the solid, stable bone in most cases, but some bones have more blood supply so they heal faster. Toe bones have less mass and more circulation thus they heal faster. Wrist bones, on the other hand, can take longer.

The outer layer of the bone is made of hardened mineral deposits, whereas the inner layer is porous and bloody with a soft substance called “marrow.” The red marrow makes red blood cells, while the yellow marrow is used to store fat.

Bones continually undergo changes in a process called “bone remodeling.” Osteoclast cells break down old bone and osteoblast cells trigger new bone cells to form. As soon as a bone breaks, the osteoblasts begin mending the bone, sometimes even when they are out of alignment.

But this process is long and painful leaving many (especially older) patients wondering how they can speed the process as well as create a more complete healing process. Well, natural healing advocates say that they may have the answer.

Broken Bones and Natural Healing

If they are set properly and the person is careful not to put any strain on the area, the bone will eventually knit itself. Though there are no drugs in conventional medicine to help this process along, there are many things that believers in natural healing swear hurries the process along and helps in more complete healing.

  • Stop smoking – There are tons of reasons to stop smoking, but when it comes to bone healing, the science is pretty solid on this issue. Smoking slows the blood flow to the bones, thereby slowing the healing process.
  • Stop drinking alcohol – Another fairly obvious one that slows the formation of the osteoblasts.
  • Stop drinking caffeine – This is a hard one to do for Puget Sound residents, but by eliminating caffeinated drinks such as coffee, tea, and soft drinks, you can seriously curb calcium excretion. Since your body needs all the calcium it can get to heal your bones, it is wise to minimize ALL sources of calcium loss.
  • Healthy Foods – Bones need protein to build, so it’s wise to add proteins to your diet. One major source of protein for bone patients is milk, because it also adds much needed calcium to the mix. Other proteins that are good are:
    • Meat
    • Fish
    • Soy
    • Nuts
    • Beans
  • Calcium Supplements – Most doctors recommend at least at 800-1200 milligrams of calcium a day for adults. There is little research connecting the addition of calcium to the diet to the increased speed of bone healing, however, taking the recommended daily amount can’t hurt.
  • Vitamin C – Vitamin C is probably the largest contributor to the formation of collagen, the main component in connective tissue. Adding more fruits and vegetables to your diet contribute greatly to collagen creation. ,
  • Vitamin D – This aids in calcium absorption with 2,000 to 4,000 IU daily dose. Sitting in the sun for less than 30 minutes creates about 10,000 IU, however, it is processed differently. Be sure to take in that much while healing bones and take it in tandem with Omega 3 supplements to aid absorption.
  • Vitamin K – This can be found in course leafy greens such as kale and collard greens, also aids bone repair.
  • Arnica – This flowering plant some people say has a remarkable ability to reduce bruising and swelling from trauma. They recommend using it immediately after the break, to reduce swelling and vascular congestion. Be aware that you should ONLY take it in small amounts, follow the directions explicitly, and only purchase it at certified vitamin supplement stores and pharmacies.
  • Ultrasound bone growth stimulators – These machines were approved by the FDA, and treatments are available to speed certain types of broken bones with the use of electrical stimulation, ultrasound, and magnets. It increase blood flow to the area. It can be expensive and may not be recommended for all patients.
  • Deep tissue massage – When massage and techniques like cranio-sacral massage are delivered by a professional certified in injury massage, it has proven to increase blood flow and aid in the healing process.
